The Abermoray Garden Collective

This Terms of Use Agreement (the “Agreement” or “TOU”) is a legally binding agreement between You (“You” or “Your”) and The Abermoray Garden Collective, its subsidiaries and affiliates (collectively “AGC”). AGC maintains this website (the "Site") for Your personal entertainment, and to provide information, education, and facilitate communication with You (the “Services”). By browsing the Site and/or using the Services, You acknowledge and agree that You have read this Agreement, that You understand it, and that You consent to be bound by all of its terms. You represent and warrant that You have the power to enter into this Agreement and You acknowledge and agree that Your only recourse if You do not agree with the Agreement is not to access the Site or use the Services.

The Services, the Site and everything You see or read on the Site including all content, images, graphics, interfaces, trademarks, logos, service marks, design, "look and feel" of the Site and any other content that is uploaded from time to time (collectively the “Content”) is the property of AGC (and its licensors) are protected by Canadian, United States and international copyright laws and copyright treaties as well as trademark and other intellectual property laws and treaties. You may not reproduce, retransmit, distribute, share with third parties or use the Content or Services in any manner other than in accordance with the intended aims and purposes of the Site and this TOU.

You may download Content displayed on the Site for non-commercial, personal use only, provided You also retain all copyright and other proprietary notices contained on the materials.

While AGC uses reasonable efforts to include accurate and up-to-date information on the Site, AGC makes no warranties or representations as to its accuracy. AGC assumes no liability or responsibility for any errors or omissions in the Content or on the Site.

AGC may provide links on the Site to third party websites and/or services not under the control of AGC. You agree that AGC does not endorse such other websites or services and bears no responsibility for the same. If You choose to access such websites and/or services, You do so at Your own risk.

Your also agree that You are using and browsing of the Site is at Your risk. Neither AGC, nor any other party involved in creating, providing Content, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of Your access to, or use of, the Site. Without limiting the foregoing, everything on the Site is provided to You "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AGC also assumes no responsibility and shall not be liable for any damage to or viruses that may infect Your computer equipment or other property, or for any loss or corruption of data on account of Your access to, use of, or browsing in the Site, or Your downloading of any Content including data, text, images, video, or audio from the Site.

AGC SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING OUT OF THIS AGREEMENT OR THE USE OF THE SERVICES OR SITE BY YOU.

You agree to indemnify and hold AGC, its officers, directors, shareholders and successors in interest, employees and agents harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against AGC by any third party due to or arising out of or in connection with Your use of the Services and/or Site.

The provisions of this Agreement shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

If any part of the Agreement is found to be illegal, invalid or otherwise unenforceable, that part shall be severed from this Agreement and the rest of the provisions shall remain in full force and effect.

AGC may at any time revise this Agreement by updating this posting without notice to You. Each time You visit this Site, You are bound by this Agreement as it exists on the date of Your visit. You are bound by any such revisions and should therefore periodically visit this page to review the then-current Agreement to which You are bound.
